The Epson v OW Supplies Case Reaches Judgment

On July 17 2017, the US District Court in Portland, Oregan, has ‘stipulated final consent judgment and permanent injunction’ to Californian aftermarket companies OW Supplies Corp. and SMART AND EAZY CORP. Epson filed a class action lawsuit against aftermarket suppliers of ink cartridges in March, 2017.

The defendants were accused of infringement of US Patent 6,502,917 and US Patent 8,794,749. The court has sided with Epson and prohibited the defendants from further sale of the infringing products.

According to the court documents, it appears that Epson has already settled the case with OW et. al. outside the court prior to the decision. In terms of incurrences of damage compensations, the court has decided “remedies for past infringement shall be in accordance with a Confidential Settlement Agreement made and entered into by the parties on June 30, 2017.”
