Ninestar Settles Dongle Gear Complaint with Canon

Ninestar released a public statement saying it has agreed to resolve the pending dispute with Canon in the U.S. International Trade Commission (USITC) and U.S. District Court for the Southern District of New York.

In May 2014, Canon filed a complaint with the USITC against 33 manufacturers, distributors and sellers of toner cartridges for infringement of its dongle gear related patents. Ninestar was one of the respondents.

The aftermarket supplier was accused by Canon of infringing its US Patent Nos. 8,280,278; 8,433,219; 8,437,669; 8,494,411; 8,630,564; 8,676,090; 8,682,215; and 8,688,008. These patents relate to a “dongle type rotating arm on the OPC drum used in more than 50 models of Canon and Hewlett-Packard laser beam printers.”

According to the statement, Ninestar will stipulate to a Consent Order from the USITC and a Consent Judgment and Permanent Injunction from the Southern District of New York, which will prohibit Ninestar from making, using, selling, or offering for sale in the U.S., and from importing into the U.S. the toner cartridges that Canon accused of infringement.

Before the resolution, Ninestar Image Tech Limited, Zhuhai Seine Technology Co., Ltd., Ninestar Technology Co., Ltd., Seine Tech (USA) Co., Ltd., Seine Image Int’l Co., Ltd., Ninestar Image Tech, Ltd., Seine Image (USA) Co., Ltd., and Nano Pacific Corporation (collectively, “Ninestar”) submitted a permissible repair Motion to the USITC, opposing Canon’s alleged infringement claim. However, the motion was denied by ALJ David P. Shaw.
