Canon Closes Another Patent Dispute

Canon Closes Another Patent DisputeCanon Inc. announced that it signed a settlement agreement with One Connection Limited and its managing director in order to resolve their patent dispute regarding Canon’s European Patent EP 1 977 289 B1 (“EP ‘289”).

The matter at issue concerns the offering and distribution of certain laser toner cartridges by One Connection Limited via, e.g., www.amazon.co.uk, www.amazon.fr and www.amazon.es. The settlement agreement inter alia includes a European-wide cease-and-desist declaration, whereupon One Connection Limited and its managing director are prohibited from making, disposing of, offering to dispose of, using, importing or keeping certain laser toner cartridges that infringe claims 1 and 2 of EP ‘289 in all countries where EP ‘289 is valid and in force. The cartridges at issue include a developing unit moveable relative to the drum unit when receiving force via a force receiving device.

Furthermore, One Connection Limited has agreed to pay damages for past infringement to Canon. Further details of the settlement agreement are confidential.

In March, Canon Inc. and Print-klex GmbH & Co. KG, doing business as “Print-klex” and “123 color”, as well as its managing director, agreed to resolve their pending patent infringement litigation (docket no. 4a O 1/20) based on EP 1 977 289 (in the following: “EP ‘289”) by signing a settlement agreement.

The litigation is based on infringement of the German portion of Canon’s EP ‘289 and concerns the offering and distribution of certain laser toner cartridges through https://print-klex.dewww.ebay.de and www.amazon.de. The infringing cartridges include a developing unit moveable relative to the drum unit when receiving force via a force receiving device.
