Canon and Ninestar Settle Over US Cartridge Dispute

Canon and Ninestar Settle Over US Cartridge DisputeCanon and Ninestar have resolved their pending lawsuit in the U.S. District Court for the Central District of California.

On September 17, 2020, Canon filed a complaint with the U.S. District Court against Ninestar Corporation, Ninestar Image Tech Limited, and Ninestar Technology Company, Ltd. (collectively, “Ninestar”), for allegedly infringing Canon’s U.S. Patent Nos. 9,851,688; 9,857,766; 10,620,582; 10,712,709; and 10,712,710.

Canon released a statement on its website on January 5, 2021, stating “To resolve the lawsuit, Ninestar has agreed to stop making, using, selling and offering for sale in the U.S., and importing into the U.S., the toner cartridges that Canon accused of infringement.”

Within 24 hours of the Canon statement, Ninestar issued a press release stating much the same as the Canon message but with one major addition. Ninestar has added the words, “without admitting any wrongdoing” and “amicably resolve”so that their statement reads: “Without admitting any wrongdoing, in order to amicably resolve the lawsuit, Ninestar has agreed to stop making, using, selling and offering for sale in the U.S., and importing into the U.S., the toner cartridges that Canon accused of infringement.”

One industry commentator in the US contacted RT Media and said, “This is a ‘revenge’ action on the part of Canon after Canon lost big time on April 20 against several aftermarket players, including Ninestar, as well as Aster, Print-Rite, LD Products, and The Supplies Guys.” He added, “It is quite possible this September 17 filing is one of the ‘options’ Canon said it may choose to pursue.

Both parties have categorically stated that further details of the settlement agreement are confidential.
