Two Seizure and Forfeiture Orders Issued against Environmental Office Solutions

Authorities have advised the U.S. International Trade Commission (USITC) that cartridges banned by a General Exclusion Order (GEO) have been seized before entry into the United States.

Copies of orders dated August 27, sent to RT Media, clearly state the U.S. Bureau of Customs and Border Protection notified the USITC of the seizure.  In response the USITC issued the seizure and forfeiture order covering certain inkjet cartridges covered by a General Exclusion Order (GEO) in the 337-TA-740 investigation.

The document identifies Connecticut-based Environmental Office Solutions as being the importer of the cartridges that violate the GEO.

On August 20, 2010, Lexmark International, Inc. filed a complaint alleging violations of section 337 based upon the importation into the U.S., the sale for importation, and the sale within the U.S. after importation of certain toner cartridges and components thereof by reason of infringing the following U.S. Patent Nos. 5,337,032; 5,634,169; 5,758,233; 5,768,661; 5,802,432; 5,875,378; 6,009,291; 6,078,771; 6,397,015; 6,459,876; 6,816,692; 6,871,031; 7,139,510; 7,233,760; 7,305,204. USITC decided to institute a 337 investigation on October 12, 2010. Following the completion of the investigation, titled 337-TA-740, the USITC issued the GEO.

Also on August 27, another seizure and forfeiture order, relating to inkjet ink supplies investigation (337-TA-691), has been issued against Environmental Office Solutions. This investigation was instituted on October 29, 2009, which based upon HP’s complaint filed on September 23, 2009. USITC granted a GEO and terminated this investigation on January 7, 2011.
