Seizure Order Overturned Again

The US International Trade Commission (USITC) has formally rescinded (overturned) the seizure and forfeiture order issued against Green Project Inc.

It is the second time this year the USITC has reversed its orders. On January 25, 2017 it reversed its orders against Clover Technologies Group.

In this second reversal, Green Project, a California-based company had been subject to Investigation No. 337-TA-723 on February 28, 2017.

According to the rescission letter, products imported into the USA by Green Project Inc. which had been denied entry by the U.S. Customs and Border Protection (the Customs) in December, 2016 would now be allowed entry.

Such products included certain inkjet ink cartridges with printheads and components. The USITC had originally issued a seizure and forfeiture orders believing them to be in violation of the general exclusion order (GEO) related to the No. 337-TA-723 investigation regarding HP on December 29, 2016.

On February 23, 2017, Customs reported to the USITC that it had reversed the denial of the entry of the products. Hence, the USITC decided that the order should be rescinded.

Lisa R. Barton, secretary to USITC, declared the rescission letter also covered any affiliated companies, parents, subsidiaries, or other related business entities of Green Project Inc., or any of their successors or assigns involved.
