Canon Obtains Preliminary Injunctions Against Several Companies

Over the last few days it has been announced that Canon has obtained several preliminary injunctions against various companies: Lucky Suppliers Handels GmbH, Office Partner GmbH and Druck Quality SL, which also trades under the name Konver. Canon has also taken out preliminary injunctions against the managing directors of these three companies. All preliminary injunctions have been granted by the District Court Düsseldorf.

While Lucky Suppliers Handels GmbH have signed a declaration accepting the injunction as final, Office Partner GmbH and Druck Quality SL still have the option to appeal. In all three cases Canon have brought about the preliminary injunctions due to alleged patent infringement. The preliminary injunctions against Lucky Suppliers Handels GmbH and Office Partner GmbH have requested that any infringing cartridges should be handed over to a bailiff while the matter is resolved. Druck Quality SL is alleged to have infringed the patents of two OEM cartridge models (HP CE505A and HP CF280A) whereas Lucky Suppliers Handels GmbH are alleged to have infringed the patents of twelve OEM cartridge models and Office Partner GmbH eight OEM cartridge models.

In other news, Canon has solved a patent dispute with Craig Maleedy, who trades under the name cartrite.co.uk. Craig Maleedy accepted the injunction and has agreed, going forward to no longer make, offer or put into circulation laser toner cartridges that contain a specific coupling member that is used in several Canon products including laser beam printers. This restriction applies in any country where EP 2 087 407 B1 is valid and enforced. Further information about the settlement has been kept confidential.
