USITC Issued 5 Seizure and Forfeiture Orders for Brother Investigation

USITC Issued 5 Seizure and Forfeiture Orders for Brother InvestigationInnopat told RT Media that U.S. International Trade Commission (USITC) has issued five seizure and forfeiture orders to five defendants under Brother 337 investigation. It is only 4 months after the issuance of the General Exclusion Order.

The five defendants are Amazon.com Services, Inc., Enlight Trading Inc., Princo Image Co. (USA) Inc., and two Zhuhai companies Exprinco Inc., and Thumbs Up Innovation Technology Co., Ltd.

The five importers/dealers were trying to import into U.S. certain toner cartridges, toner cartridge components as well as the system that contains the toner cartridge components. These products are covered by the General Exclusion Order issued for Brother 337-TA-1174 investigation on November 23, 2020.

Brother filed the 337-TA-1174 investigation on August 19, 2019. During the investigation, 8 companies accepted the consent order. Among the 8 companies, 6 companies’ self-designed cartridges can be imported into the U.S. market, as they are non-infringing, and not covered by the compensation order issued by USITC.

“The U.S. customs implemented the General Exclusion Order in such an efficient way. One reason might be that the U.S. customs reinforced the implementation to the General Exclusion Order. In the meantime, it could be that Brother made diligent and effective communication with the U.S. customs,” so says a spokesman from Innopat.
