USITC Issues Two 337-TA-829 Seizure and Forfeiture Orders

Two U.S.-based companies, named ITC Supplies and Inter Worldwide Trading Inc. respectively, have been denied to import certain toner cartridges and components by the U.S. Bureau of Customs and Border Protection (U.S. Customs) for violation of the 337-TA-829 General Exclusion Order (GEO).

Based on the documents submitted by the U.S. Customs, the U.S. International Trade Commission (USITC) issued two separated orders against ITC Supplies and Inter Worldwide Trading Inc., forbidding them to import certain toner cartridges and components covered by the 337-TA-829 GEO into the U.S. If the two companies violate the GEO, related products will be seized.

Canon U.S.A., Inc., Canon Virginia, Inc. and Canon, Inc. jointly filed a complaint in January 2012, requesting a 337 investigation to determine whether the respondents have violated Canon’s U.S. patents Nos. 5,903,803 and 6,128,454. In June 2013, the investigation completed with a GEO issuance.
