Infringing Company Sued by OEM Again

Seiko Epson Corporation (Epson) has filed a complaint against Nano Business & Technology, Inc (Nano) for infringing its patents and breaching contract—again.

The OEM claimed Nano has been infringing its ‘917 (US 6,502,917) and ‘749 (US 8,794,749) patents by making, importing and selling ink cartridges with Epson’s patented technology and designs in the US. The defendant was selling the products online through its website, on-line stores, Amazon and eBay.

As the complaint revealed, Nano had reached a settlement with Epson as one of the five companies involved in the Epson 337-TA-946 cases closed in 2012. The joint motion to terminate the ITC investigation was submitted on June 25, 2015. The defendant is alleged to have breached the agreement relating to the ‘917 and ‘749, along with other patents. Epson requests the infringing company to pay the damages it caused by breaching the agreement as well as the attorneys fees.

The complaint document also reveals Nano is located in a residential neighborhood and has been an ongoing business in Oregon since November 21, 2003.
