Dutch Distributors Banned for Selling Clones

The Recycler reported that Samsung has won the lawsuit against three distributors selling cloned toner cartridges in the District Court of The Hague, Netherlands.

In November 2013, Samsung filed the suit against four dealers, Yorcom Computers, Print About, Digital Revolution and Maxperian, for their sales of non-licensed and non-OEM toner cartridges in their shops, said the statement. Samsung claimed that these products imitated its cartridge design and thus infringed “the part of the cartridge that collects used toner and the contact point of the IC chip that the printer and the toner recognize each other”. But it was not noted which three lost the case. As a result, the three dealers are banned from selling infringing cartridges.

According to The Recycler, the OEM also asserted: “Samsung is pleased with the verdict of The Hague tribunal. We want to protect the rights and interests of consumers, but also those of companies that manufacture environmentally-friendly reusable cartridges.”
