Commercial Copy Innovations Files Suit against Brother

Northern California Record reported that a California corporation is suing a printer products distributor, alleging patent infringement.

Commercial Copy Innovations, Inc. filed a complaint July 5 in U.S. District Court for the Central District of California Southern Division against Brother International Corporation and Brother Industries (USA) Inc., alleging the defendants directly and/or through their distribution network, placed infringing products or systems within the stream of commerce without the plaintiff’s consent.

According to the complaint, Commercial Copy has acquired all rights and title in and to U.S. patent for certain products developed by Eastman Kodak Company for the purpose of enforcing the rights embodied therein. The plaintiff says these asserted patents have been copied, manufactured and sold within the stream of commerce by Brother International without the plaintiff’s knowledge, authority or consent.

The plaintiff alleges the defendants market, uses, sells, offers for sale, manufactures, has manufactured, makes, or has made, imports, and/or has imported systems or products from the asserted patents of Commercial Copy without its authority, consent and rights or license.

Commercial Copy Innovations seeks trial by jury, payment for damages, costs incurred, pre- and post-judgment interest, attorney fees, and all other just and proper relief.
