Canon Granted Preliminary Injunction

Canon announces the grant of a preliminary injunction for patent infringement in Germany against Biggest Discount Ltd. et al.

Canon sued Biggest Discount Ltd. et al. in Germany for infringing the German portion of Canon’s European patent EP 2 087 407 relating to a drum unit and a process cartridge.

According to Canon Inc., it has obtained a preliminary injunction, which among other things contains injunctive relief, granted by the District Court Düsseldorf against Biggest Discount Ltd. as well as against its managing directors.

The cartridges CE505X and CE505A compatible with some HP laser beam printers was replaced by to Canon’s patent EP 2 087 407 products by offering and distributing a laser cartridges that comprises a drum unit via amazon.de under the ASINs (=Amazon Standard Identification Number) B00532ADSO and B002KNJKGA.

Although the defendants can file an objection against the preliminary injunction because it is not yet final. However, Canon can enforce the decision as service on Defendants was effected.
