Canon Continue to Prevail Over OPC Drum Patent Infringements

Their case before the District Court of Düsseldorf against Mr. Thomas Zenkel, owner of the domain “tintenalarm.de”, concerned the German portion of Canon’s European patent 2,087,407 relating to, OPC drums. The lawsuit concerned among other things, the offering and sale of certain toner cartridges with infringing drum units for use in various models of Canon and Hewlett-Packard laser printers.

According to Canon, in the court’s ruling back on June 11, 2015, Mr. Zenkel acting under “tintenalarm.de” was prohibited from using, selling and offering the infringing photosensitive drum units in Germany and ordered Mr. Zenkel to recall the said products from the distribution channel. A declaratory decision on liability for damages is also included in this final decision.
