Washington-based Company Denied Inkjet Cartridges Imports

Another Seizure and Forfeiture Order has been issued to a Washington-based company for attempting to import certain inkjet cartridges that violate the standing General Exclusion Order related to No. 337-TA-740 investigation. 

According to the legal documents submitted to RT Media, Washington-based YMCK Systems Inc. has allegedly violated the GEO related to No. 337-TA-740 investigation. The U.S. Bureau of Customs and Border Protection (“Customs”) has denied the entry of the imported products from YMCK Systems Inc. and reported to the U.S. International Trade Commission (USITC). In response to the Customs’ report, the USITC approved and issued the seizure and forfeiture order against the company.
 
On August 20, 2010, Lexmark International, Inc. filed a complaint alleging violations of section 337 based upon the importation into the U.S., the sale for importation, and the sale within the U.S. after importation of certain toner cartridges and components thereof by reason of infringing the following U.S. Patent Nos. 5,337,032; 5,634,169; 5,758,233; 5,768,661; 5,802,432; 5,875,378; 6,009,291; 6,078,771; 6,397,015; 6,459,876; 6,816,692; 6,871,031; 7,139,510; 7,233,760; 7,305,204. USITC decided to institute a 337 investigation on October 12, 2010. Following the completion of the investigation, titled 337-TA-740, the USITC issued the GEO.
