Amazon Removes Infringing Cartridges in Canada USA and Europe

Amazon Removes Infringing Cartridges in Canada USA and EuropeCanon continues to make requests to remove certain cartridge products from Amazon listings that allegedly infringe its patents.

  • USA: The company claimed it filed an infringement report with Amazon.com seeking the removal of Amazon.com listings for certain toner cartridges sold by NineLeafToner for use in HP laser beam printers. At the time of this announcement, the above-identified NineLeafToner listings were no longer available on Amazon.com. Canon’s infringement report alleged that certain models including CE505A, CE505X, CE255X and CF280A toner cartridges sold by SuperInkToner via Amazon.com infringed Canon’s U.S. Patent Nos. 8,280,278; 8,630,564; 8,682,215; 8,688,008; and 8,676,090. Canon requested that Amazon remove SuperInkToner’s listings for those products, namely, SuperInkToner’s listings with Amazon Standard Identification Numbers (“ASINs”) B07N1H44QW, B07N1HSWCJ, B06Y5RFLR1, B07MGR8G3J, B07WCMZ7FV, B07MD5LFDG, B07N1GSKFP, B07WD35VWL, B07N1H6D81, B07WF6RWRG, B07N1HGPC7, B07WF6S2TW, B07WG72SZX, B07MZTCJ6P, B07KR5B9K1, B07ZKRC6SX, B07ZKSFGZF, B07ZKV75Y8, B07ZKVRC33, B07ZKWH6SC, B07Y561WV2, B07Y538YKN, B07Y55JLQN, B07Y54SF1J and B07Y562XKH.
  • Europe: On the same day, Canon said it filed report infringement forms with Amazon.de, Amazon.it, Amazon.co.uk and Amazon.es based on the alleged use of claims 1 and 2 of the German, Italian, UK and Spanish portions of Canon’s European Patent EP 1 977 289 B1 (“EP ‘289”) regarding certain models of toner cartridges offered by Printperfect Ltd, trading on Amazon as “PerfectPrint,” under the following ASINs (Amazon Standard Identification Numbers). Afterwards, Amazon took down the respective products. These products are compatible with the OEM HP cartridge models and provide inter alia a non-OEM housing and a non-OEM force receiving device according to claim 1 of EP ‘289. Furthermore, they comprise an elastic portion according to claim 2 of EP ‘289.

  • Canada: For the third time on the same day, Canon reported it had filed an infringement report with Amazon.ca seeking the removal of an Amazon.ca listing for certain toner cartridges sold by Florence. Canon’s infringement report alleged that certain model CF210A, CF211A, CF212A and CF213A toner cartridges sold by florences via Amazon.ca infringed Canon’s Canadian Patent no. 2,635,791. Canon requested the removal of the corresponding listings for these products, having Amazon Standard Identification Numbers B0824FXDSL, B0823PKQ74, B0823PBWXH, B0824CZY93, B0823NYCWM, B0824DVNCB, B0824CWTDY, B0823P92T4, B0824F839G, B0823QK4ZH, B0824DVKCV, B0823NSTGJ, B0824FF9BK, B0824F5GKJ, B0824DG7SK, B0823NVG6Z, B0823NSPTW, B0823NX7YK, B0824F66YZ, B0824DQR3P, B0823NWNL3, B0824DF1L7, B0823P37YK, B0823P4B61, B0824G639B, B0823PB16N, B0824FBMF4, B0823P1CCS and B0823NVKF1. At the time of this announcement, the above-identified listings were no longer available on Amazon.ca.
